TERMS & CONDITIONS FOR CLIENT

The below terms and conditions are a legal binding agreement between you as the client and Rockmybaby Group & Janine Kiely ECE Consultants Ltd  as the agency. Completion of the Babysitter Request Form and Contract of Service Form (this form is completed on arrival of sitter) is instant acceptance of the agency Terms and Conditions.

RMB has endeavored to select suitable babysitters and nannies to take care of your precious children and all your childcare needs. We believe we have a thorough interview process which includes interviews, numerous reference checks and a police screen to present you with a childcare worker that is of a high standard.

RMB acts as an agent for you, not as an employer of the nanny or babysitter. Therefore the agency accepts no liability or responsibility for accident, injury, loss, damage or misconduct sustained by nanny or babysitter, you or any other persons and by employing a nanny or babysitter through RMB you agree to exclude the agency should any mishap occur.

Although RMB has high expectations of our nannies or babysitters and we aim to provide you with exceptional nannies and sitters there is still no complete guarantee of reliability, honesty and character of the sitter provided by the agency. If you have any concerns, please contact us immediately.

If cancellation of the babysitter is within 3 hours of start time, a minimum of 3 hours will be charged to you and forward onto the babysitter. If wedding or event care packages are cancelled within 7 days of start date, then a 50% charge will occur. Overdue accounts will incur a penalty interest of 24% per annum and if referred to a collection agency additional costs will be incurred, which are your responsibility.

Refunds

Although RMB endeavor to find a babysitter for you on request we can not always guarantee this will be possible. In the unfortunate circumstance where a babysitter can not be found for your requested date/s a full refund of the RMB agency fee will be given. This full refund also applies if the booked babysitter cancels or no-shows to your job and a second babysitter can not be found. The annual babysitting subscription - if a babysitter does not accept your booking, then we give an extra week onto your subcription, no refunds are given for this service.

RMB can not be held responsible for cancellations or no-shows of a babysitter.

RMB holds the right not to dispatch a babysitter if the agency fee has not been received in our bank account within 24 hours of commencement date.

All babysitting bookings must be made directly between you (the client) and RMB (the agency). No bookings are to be made direct with the babysitter. Should this condition be ignored the babysitter is legally obliged to inform the agency and the relevant fees will be charged.

Nanny placement fees are to be paid prior to the nanny commencing work. The invoice will be sent via email with payment within 5 days, this will be charged once confirmation of nanny is made by you the client and the nanny. RMB holds the right to withhold start date of nanny if agency fee has not been paid.

RMB require our nannies and babysitters to be in a safe, warm and friendly environment. RMB sincerely appreciate your business. Our aim is to provide you with a safe and efficient service. If you have any queries please do not hesitate to call us.

CLIENT ACKNOWLEDGEMENT

As a customer of Rockmybaby™ (RMB) you acknowledge:

1. RMB requires you to provide accurate details of your address, contact details and full name. RMB does not sell or rent your personal information or identification to third parties. We release account and other personal information only when the above release is appropriate for the function of the website, to comply with the law; enforcement of our terms and conditions; or protect the rights, property, or safety of RMB Limited, our users or others. However you do authorise your babysitter to tell a family member or friend where she will be, her expected return time and your home phone number. This is a simple safety measure for the babysitter.
2. Babysitters will be asked to provide constructive feedback to RMB from their experience providing babysitting services to you.
3. RMB will make a babysitters feedback available to other babysitters who provide their services through RMB. You acknowledge such feedback is the opinion of the sitter and not a statement of fact.
4. Where RMB (in its absolute discretion) believes that there is sufficient negative feedback or feedback is of a concerning nature then RMB will not refer jobs for you or to your address to the RMB babysitters.
5. By using the RMB Agency you expressly authorize RMB to collect and publish information about you as detailed in these terms and conditions and you expressly waive any right, whether in statute or at common law, to bring any legal action against RMB as a result of RMB's publication of such information, whether you consider that information to be fair and accurate or not.
6. RMB will not enter into any debate or discussion regarding the accuracy or appropriateness of feedback given by the babysitters published by RMB. However, RMB will not publish profane or silly feedback and is primarily concerned with safety and reliability issues. Therefore if you seek a sitter for three children in one family and the sitter arrives to have six children from three families you will get negative feedback which will be made available to other sitters. Other relevant feedback issues include but are not limited to:
   • promptness of payment;
   • suitability of your home;
   • reliability of time frames;
   • whether the sitter felt comfortable with your job and you as a customer;
   • the type of drive (e.g. windy road took half an hour); etc.
7. The Terms and Conditions are the terms on which RMB offers you access to the services and use of the RMB website and agency. By registering with RMB you agree to abide by these terms and conditions. If you do not agree to abide by the terms and conditions then you must refrain from using the RMB website.

RMB Agency reserves the right to Change our Terms and Conditions at any stage.
